Privacy Policy

O'Shea Equipment Company ("OEC," "we," "us," or "our") respects your privacy. This Privacy Policy explains what personal information we collect through osheaequipment.com (the "Site") and our related services (collectively, the "Services"), how we use and share it, and the rights and choices available to you under U.S. law, including the California Consumer Privacy Act as amended by the California Privacy Rights Act ("CCPA/CPRA"), the California Invasion of Privacy Act ("CIPA"), the federal CAN-SPAM Act, the Telephone Consumer Protection Act ("TCPA"), and the Children's Online Privacy Protection Act ("COPPA").

1. Information We Collect

We collect the following categories of personal information:

  • Identifiers & contact information you provide via forms, email, phone, or accounts — such as name, company, email address, phone number, mailing address, and job details.
  • Commercial information — rental, quote, and purchase inquiries, invoices, and payment records (payment card data is processed by our payment processor and is not stored on our servers).
  • Internet or network activity — IP address, browser type, device identifiers, pages viewed, referring URLs, and interactions with the Site, collected through cookies, log files, and similar technologies.
  • Communications content — messages you send us through contact forms, chat, email, or SMS, and records of customer support interactions.
  • Geolocation — approximate location derived from IP address (not precise GPS).

We do not knowingly collect sensitive personal information (such as Social Security numbers, government IDs, precise geolocation, biometric data, or health information) through the Site.

2. How We Use Personal Information

  • To respond to quote requests, rental inquiries, and support questions.
  • To provide, invoice, and service equipment rentals and purchases.
  • To operate, secure, monitor, and improve the Site and Services.
  • To send transactional messages and, with your consent where required, marketing communications.
  • To detect and prevent fraud, abuse, and unauthorized access.
  • To comply with legal obligations and enforce our agreements.

3. How We Share Information

We share personal information only as needed and with the following categories of recipients:

  • Service providers that host the Site, provide analytics, send email, process payments, provide accounting (e.g., QuickBooks Online), and provide customer support, in each case under written contracts limiting their use of the data.
  • Professional advisors such as attorneys, accountants, and insurers.
  • Government authorities when required by law, subpoena, court order, or to protect our rights, property, or safety, or that of others.
  • Successors in connection with a merger, acquisition, financing, or sale of assets.

We do not sell your personal information for money. In the last 12 months we have not "sold" personal information as that term is defined by the CCPA/CPRA. We may "share" limited online identifiers with analytics providers for cross-context behavioral advertising purposes; you may opt out as described in Section 6.

4. Cookies, Analytics & Session Recording (CIPA Notice)

We use cookies and similar technologies for essential Site functionality, security, and to understand how visitors use the Site. We may use analytics tools that record page interactions (such as clicks, scrolls, and form activity) to help us improve the Site. Sensitive input fields are masked where technically feasible.

California Invasion of Privacy Act (CIPA) notice. By using the Site, you consent to the collection, recording, and analysis of your interactions with the Site (including session replay of non-sensitive interactions and chat transcripts) by us and our service providers acting on our behalf. You may withdraw consent at any time by discontinuing use of the Site, disabling cookies in your browser, or contacting us using the details below. We do not eavesdrop on, wiretap, or record telephone conversations without notice; if a call is being recorded for quality or training purposes, you will be informed at the start of the call and may request that we not record.

5. Email & SMS Communications

Marketing emails comply with the CAN-SPAM Act and include an unsubscribe link. If you provide a mobile number and opt in, we may send transactional or informational SMS messages consistent with the TCPA. Reply STOP to opt out; message and data rates may apply.

6. Your U.S. Privacy Rights

Depending on your state of residence (including California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, and other states with comprehensive privacy laws), you may have the right to:

  • Know and access the personal information we hold about you.
  • Request deletion or correction of your personal information.
  • Opt out of "sales" or "sharing" of personal information for cross-context behavioral advertising.
  • Limit the use of sensitive personal information (we do not use sensitive PI for inferring characteristics).
  • Appeal a denial of a rights request.
  • Be free from unlawful discrimination or retaliation for exercising these rights.

To exercise these rights, email admin@osheaequipment.com with the subject line "Privacy Rights Request." We will verify your request using the information you have provided us and respond within the timeframes required by law. You may designate an authorized agent to submit a request on your behalf with written permission.

Global Privacy Control: We honor recognized opt-out preference signals such as the Global Privacy Control (GPC) as an opt-out of "sale" and "sharing" for California users.

"Shine the Light" (Cal. Civ. Code § 1798.83): California residents may request information about disclosures of personal information to third parties for their direct marketing purposes. We do not share personal information with third parties for their own direct marketing purposes.

7. Data Retention & Security

We retain personal information only as long as necessary to provide the Services, comply with legal and tax obligations, resolve disputes, and enforce our agreements. We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is 100% secure.

8. Children's Privacy

The Site is intended for a business audience and is not directed to children under 13. We do not knowingly collect personal information from children under 13 in violation of COPPA. If you believe a child has provided us personal information, contact us and we will delete it.

9. Third-Party Links

The Site may link to third-party websites (including Intuit / QuickBooks Online for accounting integrations you initiate). Their privacy practices are governed by their own policies.

10. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be posted here with a new "Effective date." Continued use of the Site after changes become effective constitutes acceptance.
